House rent law in Nepal is governed by Muluki Civil Code 2074.
House is referred to as any house, story, unit, or room of the house or land
or cartilage occupied by such a house.

If a person who has the right, possession, or ownership in a house lends gives the house to another person to use it for a certain period of time, then it is called house rent.

House Rent Law in Nepal – Legal Provisions

According to Muluki Civil Code 2074, a provision regarding house rent law in Nepal,

Section 384

No person should rent or take on rent a house that is not safe for human habitation from health and security perspectives.

Section 385

The time period for renting the house should be as per the agreement not exceeding 5 years. If a house is rented for a commercial purpose, it shall be as set forth in the agreement.

After the expiry of the time period, it can be extended with an agreement.

Section 386

Agreement should be done by the house owners and renters mentioning the following matters in an agreement:

  1. Full title and address of the proprietor and of the inhabitant, their citizenship number, and international id or recognizable proof certificate, within the case of a foreigner.
  2. Place and plot number of the arrival where the house is located.
  3. The reason for the rent.
  4. Date of graduation of rent.
  5. The legitimacy period of rent.
  6. Monthly rent.
  7. Time and mode of installment of rent.
  8. Liability to pay duties on power, water supply, telephone, etc. utilized within the house.
  9. Matter on the installment of house lease tax.
  10. If the leased house is to be a safety net provider, things relating thereto.
  11. Matter of clearing out the leased house and removal of the occupant from it.
  12. Matter as to whether the leased house can be sublet to another.
  13. Other vital things.

It is not necessary to enter into an agreement in writing with the tenant if the monthly house rent does not exceed twenty thousand rupees.

The agreement should also be signed by at least two witnesses each by the house owner and the tenant, and a copy of the agreement should be kept by the owner and the tenant.

Section 387

Details of House to be Provided

The owner should disclose the weakness or fault, if any, in the structure of the house to the tenant.

Obligations of House Owner

  1. To permit the inhabitant to utilize the house in understanding with the agreement.
  2. To orchestrate for such water and power supply, sewerage, and sanitation within the leased house as may be required, but as otherwise given for within the agreement.
  3. To avoid the inhabitant from insecurity, harassment, or distress from other people staying within the house.
  4. To stand by the other things set within the understanding.

Obligations of House Renter

  1. To pay the lease to the house proprietor within the required period.
  2. To keep up sanitation in, pay attention to, ensure, and defend the leased house appropriately and sensibly, as in the event that it were his or her own.
  3. Not to do any exercises such as causing distress, badgering, or uncertainty to the other tenants within the house or neighbors.

Mode and Structure of the Payment

House renters should pay according to the agreement. If there is no agreement regarding the payment then payment should be done within 7 days after the expiry of the month.

Obligation to Pay Tax and Other Charges

Except as in the agreement, it is the duty of the house owner to pay the tax leviable by law for the house rented. If the house owner doesn’t pay the tax, the house renter may pay the tax and such payment is deducted from the house renter while paying the rent.

Insurance of House

A house renter who rents a house for industrial or business purposes shall make the insurance of the house for its security.

Repair and Maintenance of House Rented

Except as an agreement, the house renter is obliged to repair and maintain the house.

Can the house owner check the rented house?

Yes, the house owner can check the rented house by giving a pre-notice.

Can a house renter leave the rented house before the expiration date?

Yes, a house renter can leave the rented house before the expiration period under the following conditions:
1. If the house owner fails to perform his or her obligations pursuant to Section 389.
2. If the tenant no longer needs the house for the purpose
for which he or she rented it.
3. If the house owner does any act in contravention of the
agreement or this Chapter.
*The house renter should give a notice of leaving in writing to the house owner in advance of at least thirty-five days.

Can the house owner remove the house renter from the house?

Yes, the house proprietor can evacuate the house tenant from the house beneath the taking after conditions:
1. In the event that the occupant falls flat to perform his or her commitments compatible with Section 390.
2. In the event that the occupant commits within the leased house any offense related to action disallowed by law.
3. In the event that the house proprietor needs the house for himself or herself.
4. In the event that it is fundamental to repair and keep up the house by expelling occupants from the house.

  3. a tenant does not pay a rent for 3 month and remain out of contact, an owner locked the room/shutter after then and its 4.5 months now. The tenant came to contact now and say he will pay only the rent of 3 month but the owner is demanding the rent of 4.5 months since the space is still occupied with tenant goods/stuffs. What whould be the solution?

  4. Tenant left the house without paying rent and also left his belongings as it is. Also modified the internal structure of room by removing the wall. We have contract to leave the house in the condition like before renting. What legal action we can take in this case?

  5. A person has been using some space of my house (ground floor) for selling clothes for more than thirty years now. There is no contract between us specifying the use of the space. In such case, can the person create problem by denying to leave the space, when I need it, on the ground that he has been using it for so long?
